Terms of Service

In short: you may use BasketWatch data inside your own business and products, including showing individual prices or nutrition values to your own users. You may not resell or redistribute the data in bulk, or use it to build a competing data product. The data is compiled from public sources, is provided as is, and must never be relied on for allergy, dietary or medical decisions. These points are summarised here for convenience; the full terms below are what apply.
1. About these terms
These Terms of Service ("Terms") govern your use of the BasketWatch website, dashboard, reports, application programming interface ("API"), agent and MCP access, and the data made available through them (together, the "Service"). "BasketWatch", "we", "us" and "our" mean the provider of the Service. "You" means the person or organisation using the Service.
By creating an account, buying credits or a subscription, receiving an API key, or using the Service, you agree to these Terms. If you use the Service on behalf of an organisation, you confirm that you are authorised to accept these Terms for it, and "you" includes that organisation.
The Service is intended for business and professional use. If you are a consumer, nothing in these Terms affects rights you have under consumer protection law that cannot be excluded.
2. Accounts and API keys
- Your API key identifies your account. Keep it confidential and do not share it outside your organisation. You are responsible for all use of the Service made with your key.
- Tell us promptly at info@basketwatchireland.com if you believe your key has been exposed. We may rotate, suspend or revoke a key that we reasonably believe has been compromised or misused.
- You must give us accurate account and contact details and keep them up to date.
3. Credits, subscriptions and payment
- Credits. API access is paid for with prepaid credits. One credit returns one record. A barcode lookup costs one credit per barcode found, however many retailers list it, and nothing for a barcode we do not hold. Credits are only charged for successful responses, and your remaining balance is reported with every response.
- Credits do not expire. If we permanently discontinue the API, we will refund the value of any unused credits on your account.
- Refunds. Unused credits can be refunded within 14 days of purchase. Credits already spent cannot be refunded, because the data has been delivered.
- Complimentary credits. Credits we give free of charge have no cash value, cannot be refunded or transferred, and may be withdrawn if misused.
- Subscriptions. Dashboard and report subscriptions are billed in advance and renew automatically each period until cancelled. You can cancel at any time; cancellation takes effect at the end of the period already paid for, and partial periods are not refunded except where the law requires it.
- Prices. Prices are as shown at the time of purchase. We may change prices for future purchases; credits you have already bought keep their value. No VAT is currently charged; if that changes, it will apply only to future purchases and will be shown before you pay.
- Payment processing. Payments are processed by Stripe. We do not receive or store your full card details.
4. Your licence to use the data
Subject to these Terms and to payment, we grant you a non-exclusive, non-transferable, non-sublicensable licence to use the data you obtain from the Service ("Data"):
- for your own internal business purposes, including analysis, research and reporting; and
- within your own products and services, including showing individual Data points, such as a product's price, promotion, barcode or nutrition values, to your own end users as part of your product.
You must not, and must not allow anyone else to:
- sell, resell, sublicense, rent, publish or redistribute the Data in bulk, or as a dataset, feed, file, database or API, whether free or paid;
- use the Data to build, train, populate or improve a product or dataset that competes with, or substitutes for, the Service;
- make the Data available in a way that lets others extract it in bulk from your product;
- share, sell or lend your API key or access to the Service; or
- remove or obscure any source or attribution information we provide with the Data.
Wider rights, such as redistribution of the full catalogue or historical data, are available only under a separate written agreement with us.
When you publish analysis, reports or articles that use the Data, please credit "Source: BasketWatch".
5. Sources, third-party data and trade marks
- The Data is compiled from information that retailers make publicly available, and from other sources described below. BasketWatch is independent. We are not affiliated with, endorsed by or sponsored by Tesco, Dunnes Stores, SuperValu, Aldi, Lidl or any other retailer or brand. Retailer and brand names and trade marks belong to their owners and are used only to identify the source or product.
- Open Food Facts. Some nutrition values come from Open Food Facts and are labelled
nutrition_source: openfoodfacts. That data is © Open Food Facts contributors and is made available under the Open Database License (ODbL). If you publish or redistribute those values, you are responsible for complying with the ODbL, including attribution and its share-alike terms. We grant no rights in that data beyond the ODbL. - Barcodes (GTINs) are product identifiers and are provided for matching only. Their use does not imply any endorsement by GS1 or by the brand owner.
6. Accuracy: the data is provided as is
- We work hard to keep the Data accurate, but it is collected automatically from third-party sources at a point in time, typically once a day. Prices, promotions, availability, product details, barcodes and nutrition can be incomplete, delayed, out of date or wrong, and online prices may differ from prices in store.
- Never rely on the Data for allergy, dietary, health or medical decisions. Ingredient, allergen and nutrition information may be incomplete, out of date or wrong. Always check the product's own label. If you show this information to your users, you are responsible for telling them the same.
- To the fullest extent permitted by law, the Service and the Data are provided "as is" and "as available", without any warranty or condition of any kind, including accuracy, completeness, timeliness, availability, fitness for a particular purpose, or non-infringement.
- You are responsible for decisions you make using the Data, including pricing decisions, and for checking it is suitable for your purpose.
7. Availability and changes to the Service
We do not guarantee that the Service will be available at any particular time or free from errors, and no service-level commitment applies unless agreed in writing. We may change, suspend or discontinue any part of the Service, including retailers covered, endpoints, fields and data history, for example because a source changes or stops being available. Where a change materially reduces a paid feature, we will try to give reasonable notice.
8. Acceptable use
You must not:
- use the Service or the Data unlawfully, or in breach of anyone's rights;
- use the Data to coordinate prices or exchange competitively sensitive information with competitors, or otherwise in breach of competition law;
- attempt to bypass or interfere with rate limits, credit metering, access controls, sampling limits or other security measures, or access the Service other than through its documented interfaces;
- scrape, crawl or bulk-copy the website or dashboard, or reverse engineer the Service;
- overload, disrupt or test the vulnerability of the Service; or
- misrepresent your identity, or your relationship with BasketWatch.
9. Suspension and termination
- We may suspend or end your access, with or without notice, if you breach these Terms, if payment fails, if your use threatens the Service or other users, or if the law requires it.
- If we end your access because you breached these Terms, unused credits are forfeited and no refund is due. If we end it for any other reason, we will refund unused credits.
- You may stop using the Service at any time. Refunds are as set out in section 3.
- Sections 4 to 6 and 10 to 15 continue to apply after your access ends, and so do the restrictions on Data you obtained.
10. Limitation of liability
- Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited or excluded by law.
- Subject to that, we are not liable for any loss of profit, revenue, business, contracts, goodwill, anticipated savings or data, for any loss arising from decisions made using the Data, or for any indirect, special or consequential loss, however caused.
- Subject to that, our total liability arising out of or in connection with the Service and these Terms, whether in contract, tort (including negligence) or otherwise, is limited to the total amount you paid us in the 12 months before the event giving rise to the claim, or €50 if you have paid us nothing.
11. Indemnity
You will indemnify us against all claims, losses, damages, costs and expenses, including reasonable legal fees, arising from your use of the Data in your products or services, your breach of these Terms, or your breach of any law or third-party right, including any licence that applies to third-party data such as the ODbL.
12. Ownership
The Service, its software and design, and the BasketWatch database, including our compilation, matching and enrichment of the Data, belong to us or our licensors and are protected by copyright, database rights and other laws. You receive only the licence set out in section 4. If you send us feedback or suggestions, we may use them freely without obligation to you.
13. Privacy
We process personal data, such as your email address and usage of the Service, as described in our Privacy Policy.
14. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a new date, and will notify active customers by email of material changes. Changes apply from the date posted; for subscriptions, material changes apply from your next renewal. If you continue to use the Service after a change applies, you accept the updated Terms.
15. Governing law and disputes
These Terms, and any dispute or claim arising out of or in connection with them or the Service, are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction. If you are a consumer, you also keep any right to bring proceedings in the courts where you live.
16. General
- These Terms, together with any order or written agreement with us, are the entire agreement between us about the Service.
- If any provision is found invalid or unenforceable, the rest of these Terms remain in effect.
- If we do not enforce a right straight away, we have not waived it.
- We may transfer our rights and obligations under these Terms to another person or business that takes over the Service. You may not transfer yours without our written consent.
- We are not responsible for delays or failures caused by events outside our reasonable control, including changes to or the unavailability of third-party sources.
- We may send notices to the email address on your account.
